This the right of a parent who does not have primary custody of a child ( in terms of residence) to take the child away with them ( visiting rights – droit de visite) and to have them sleep at their own home ( accommodation rights – droit d’hébergement).

This right is granted by the Family Court Judge ( le juge aux affaires familiales) of the Regional Court (Tribunal de Grande Instance ) and can be applied both to divorced parents as wall as former cohabiting couples who have managed to reach an agreement on the issue of custody.

Having visiting rights does not imply that a parent can see their child whenever they want but rather according to a timeframe laid out by the judge. As a general rule, visiting rights will be for the 1st, 3rd and 5th weekends of the month if the parents have regular day jobs and do not live too far from each other.
